1. DESCRIPTION OF SERVICE

Radio Check is a veteran accountability platform that enables organizations to check in on their members via SMS text messages. The Service includes:

• • SMS-based check-ins sent from Radio Check's phone number to members at their chosen frequency
• • A mobile application that serves as a companion dashboard for viewing check-in status and managing squads
• • Organization administration tools for managing members and monitoring check-in responses

2. SMS TERMS

By providing your phone number or replying to a Radio Check message, you consent to receive periodic text messages from Radio Check on behalf of your organization.

• • Message frequency depends on your selected cadence: weekly, monthly, quarterly, or annually
• • Message and data rates may apply depending on your mobile carrier and plan
• • You can opt out at any time by replying STOP to any Radio Check message
• • You can opt back in by replying JOIN
• • For help, reply HELP or contact us
• • Supported carriers include but are not limited to AT&T, Verizon, T-Mobile, and Sprint

RadioCheck SMS Terms (OTP / Account Security)

By providing your mobile number and requesting a login code, you agree to receive transactional SMS messages from RadioCheck for account authentication and security verification.

• • Program name: RadioCheck OTP / Account Security
• • Message purpose: One-time passcodes and account security verification
• • Message frequency: Messages are sent only when you request a login/verification code
• • Fees: Message and data rates may apply
• • Opt-out: Reply STOP to cancel SMS messages
• • Help: Reply HELP for help or contact support at support@radiocheck.app
• • Consent: Consent to receive SMS is not a condition of purchase
• • Carriers: Carriers are not liable for delayed or undelivered messages

3. ELIGIBILITY

The Service is intended for individuals aged 18 and older. By using the Service, you represent that you are at least 18 years old.

4. ORGANIZATION RESPONSIBILITIES

Organizations using Radio Check to check in on their members are responsible for:

• • Obtaining appropriate consent before adding a member's phone number to the Service
• • Using the Service for legitimate veteran support and accountability purposes only
• • Responding to member support requests in a timely manner
• • Complying with all applicable laws regarding SMS messaging and data privacy

5. USER CONDUCT

You agree not to:

• • Use the Service for any unlawful purpose
• • Impersonate another person or organization
• • Send spam, harassment, or threatening messages through the Service
• • Attempt to access another user's account or data without authorization
• • Interfere with or disrupt the Service

6. INTELLECTUAL PROPERTY

The Service, including its design, features, and content, is owned by Last 1 Enterprises. "Radio Check" and the Radio Check logo are trademarks of Last 1 Enterprises. You may not use our trademarks without prior written permission.

7. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. RADIO CHECK IS NOT A CRISIS INTERVENTION SERVICE, MENTAL HEALTH PROVIDER, OR EMERGENCY SERVICE.

We do not guarantee that:

• • The Service will be available at all times without interruption
• • SMS messages will be delivered successfully to all carriers
• • The Service will detect all instances of member distress

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAST 1 ENTERPRISES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.

Radio Check is a communication tool that facilitates check-ins between organizations and their members. We are not responsible for the actions or inactions of organizations or their staff in response to check-in data.

9. TERMINATION

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may stop using the Service at any time by replying STOP to any message and/or deleting your app account.

10. GOVERNING LAW

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in Travis County, Texas.

11. CHANGES TO THESE TERMS

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
